1. Please refer RFQ NO and DUE DATE on the RFQ schedule.
2. Select SPARE PARTS and SERVICES that related to your company business.
3. Note down RFQ NO and ask PROCUREMENT DIVISION personnel to assist you.
4. The completed RFQ shall be submitted to Procurement Division, Level 3, No. 1, Jalan PJU 1A/46, Off Jalan Lapangan Terbang Subang, 47301 Petaling Jaya, Selangor with complete information such as:

a) All completed RFQ shall be submitted by seal envelope and drop it in correct box (refer box day);

b) Please indicate RFQ NO and DUE DATE on top left hand corner of the envelope.

Bidders are hereby notified that notwithstanding that the Invitation to Quote consists of various or multiple items, RapidKL reserves the right to choose from any of the configurations or any combination of the configurations of the items or requirements or scope of work or supply from the Invitation to Quote. RAPID KL also reserves the right to reject any or all bids, to undertake discussions with one or more Bidders and to accept or modify the configurations of the items or requirements or scope of work or supply from the Invitation to Quote at its sole discretion and may make judgment most advantageous to RapidKL, after considering price, capacity, quality and other evaluation factors.

The quote shall be valid for a period of ninety (90) days from the expiry date of the Invitation to Quote or in the event of Reverse Auction being conducted, from the day the Reverse Auction takes place.

RapidKL reserves the right to request for extension of the validity period of the quote in the event the contract(s) is/are not made within the aforementioned period.

4.

Bidder shall provide sample or technical specifications if requested by RapidKL in the quantity and model offered at the time specified by RapidKL, failing which, RapidKL reserves the right not to consider the bid offered by the Bidder.

Bidder shall totally bear all the costs incurred by them in connection with the preparation and submission of the bid.

Bidder shall be deemed to be familiar with all the relevant laws, bylaws and regulations and any other practices in Malaysia relevant to scope of work or supply in the Invitation to Quote.

7.

Bidder shall be solely responsible for obtaining all necessary licenses, permits, qualifications, right to use patent, and other statutory and legal approval for the performance of the scope of work or supply relevant to the Invitation to Quote.

8.

Bidder’s prices shall be in accordance with the Invitation to Quote and shall include all services and other taxes and duties, working permits and other related costs required by the relevant authorities to execute the scope of work or supply relevant to the Invitation to Quote.

9.

The price shall be held firm throughout the validity period of the offer.  Upon the award of the contract, all prices offered by the successful Bidder shall remain firm throughout the contract period.

10.

The requirements stated in the scope of work or supply is based on the current needs of RapidKL. RAPIDKL reserves the right to increase or decrease the quantity depending on RAPIDKL’s necessity within the contract period.

11.

RapidKL is not obliged to give any reason for the non-acceptance or rejection of any bid.

12.

RapidKL shall not be bound to award the contract to the Bidder having the lowest quote or lowest total quotation sum.

13.

The result of the bidding shall be conclusive and binding. RapidKL is not bound to accept the lowest quote or any other offer. RapidKL shall also not entertain any correspondence for appeal from any unsuccessful bidder.

14.

Successful bidder will be notified in writing.

15.

RapidKL reserves the right to issue more than one Purchase Order, depending on the expected staggered delivery dates for the scope of work or supply relevant to the Invitation to Quote.

In the event where more than one Purchase Order is issued, as guarantee for the due performance of the Bidder’s obligation hereunder, RapidKL shall retain a sum equivalent to 5% from the total contract value payable to the Bidder (hereinafter referred to as the “Retention Sum”). The Retention Sum shall be taken from the first payment to be made to the Bidder and shall only be released together with the last payment due to the Bidder, being payment for the last batch of delivery of the items supplied.

Total contract value is calculated based on the aggregate of all Purchase Orders issued to the successful Bidder. Bidder shall agree that RapidKL may deduct in part or in full the Retention Sum in the event the successful Bidder failed to comply with the terms herein or in the Purchase Order or failed to supply and deliver the items as per the specification given or on the delivery dates or quantity stipulated by RapidKL.

In the event deduction is made from the Retention Sum, Bidder irrevocably authorizes RapidKL to retain a further sum of 5% from the total contract value for the due performance of any remaining Purchase Order(s).

Notwithstanding the above and in addition to its other rights stipulated herein or in law, RapidKL reserves the right to cancel any remaining Purchase Order at the first instance of any breach of Bidder’s obligation arising from the scope of works or supply relevant to this Invitation to Quote whether or not the remaining Purchase Order has become due.

In the event of cancellation of any Purchase Order, RapidKL shall not be liable for any cost incurred by the Bidder resulting from the said cancellation. 

17.

RapidKL reserves the right to charge penalty for late delivery. A sum of 1% from the value of each Purchase Order shall be charged for items that have not been delivered for every week or any part of the week.

18.

RapidKL reserves the right to reject the items supplied or cancel the order in the event the items supplied do not meet specifications.

19.

RapidKL shall not entertain any request for increase in price resulting from any discrepancies or difference in interpretation or understanding of the specification of the items. Any request for increase of price will not be entertained.

20.

Warranty Period for the items supplied shall be for the period described in the scope of work or supply and such warranty is given without any cost to RapidKL.

21.

Delivery of items shall be made in accordance with the specified delivery date(s) and quantity and delivered in one batch. Part delivery is not allowed. RapidKL reserves the right to reject any part delivery.

22.

RapidKL has the right to terminate all or any Purchase Order(s) at any time in the event the successful bidder fails to comply with its obligation under the order.

23.

The successful Bidder has to provide the transportation and bear the risk of the items, labour, installation and ony other things until the items are delivered to the specified location. 

24.

Acceptance will only be made upon the authorised personnel of RapidKL confirming the acceptance of the items. RapidKL reserves the right to reject any items that are damaged or not meeting specifications.

25.

The successful Bidder shall replace the damaged items or that has not met the specification. The cost of replacement shall be borne by the successful Bidder.

26.

Time is essence. Bidder shall confirm in the delivery dates agreed between RapidKL and the Bidder. In the event at failure to deliver by such dates we shall be entitled to cancel the Order and will not be responsible for any cost incurred by you.
